Dammit. I knew this was going to happen at some point on the MCs. I'm still going over last week's simulated MBE, and have now realized that this conspiracy question I had debated on for awhile and ended up getting wrong, I got it wrong because I applied
NY law instead of the multistate law. I couldn't remember which was the distinction and which wasn't, and as usual, picked the wrong one. I think those states that don't have to memorize state distinctions on multistate subjects are at
such an advantage. Grr. But on the bright side, I won't forget this distinction now!
